6 November 2017 Council Meeting

  1. Call to Order

Mayor Snyder called the meeting to order at 7:00 p.m.

  1. Pledge of Allegiance

Mayor Snyder led the room in the Pledge of Allegiance.

  1. Roll Call

Council members present: Michael Just, Steve Nolte, Kevin Smith, and Colten Fors.

Councilman Brian Shipley arrived at 7:05 p.m. at the beginning of the presentation by the Iowa Rural Water Association.

Staff present: City Clerk Kyle Michel, Planning and Zoning Chairman Mike Kappos, City Engineer Bob Veenstra, and Management Intern Miranda Wehde.

  1. Approval of the Agenda

Motioned by Nolte, items 13 and 14, consideration of Resolution 2017-115 certifying the Annual Finance Report and Resolution 2017-116 adopting the Urban Renewal Report, were added to the agenda. Seconded by Just, motion carried unanimously.

  1. Citizen Hearing and Other Communications:

None

  1. Discussion regarding Elkhart Water Supply Sanitary Survey
    • Ron Cornwall training and certification status

City Clerk provided an update of Ron Cornwell’s training and certification status to meet DNR requirements.

  • Presentation by Lisa Walters – Iowa Rural Water Association

Lisa Walters of the Iowa Rural Water Association provided a presentation on the services provided free of charge by Iowa Rural Water Association. Council discussed the services that could be utilized by Elkhart as they pertain to the Sanitary Water Survey conducted September 2017 by the IDNR.

  1. Public Hearing regarding Voluntary Annexation Applications filed with the City of Elkhart.
    • Properties owned by the City of Elkhart
    • Properties owned by Randy R. Miller and Carl J. Miller

Motioned by Nolte to open the hearing, Seconded by Smith, motion carried unanimously. The Mayor declared the hearing open at 7:17 p.m.

Motion by Just to close the hearing, Seconded by Nolte, motion carried unanimously. The Mayor declared the hearing closed at 7:06 p.m.

  1. Public Hearing on the first reading of Ordinance 2017-10: Amending the Elkhart Code of Ordinances Chapter 165 to provide for Building Code enforcement procedure.

Motioned by Just to open the hearing, Seconded by Shipley, motion carried unanimously. The Mayor declared the hearing open at 7:19 p.m.

Motioned by Just to close the hearing, Seconded by Nolte, motion carried unanimously. The Mayor declared the hearing closed at 7:21.

  1. Resolution 2017-111 a resolution assenting to the annexation of certain real estate to the city of Elkhart, IA

Motioned by Nolte, Seconded by Just, motion carried unanimously.

  1. Resolution 2017-112 a resolution directing the clerk to publish notice of hearing on the adoption of the proposed “Code of Ordinances of the City of Elkhart, Iowa” as codified by Iowa Codification.

Motioned by Nolte, Seconded by Shipley, motion carried unanimously

  1. Discussion regarding City of Elkhart Wastewater Treatment Facility project

City Engineer provided an updated timeline for the construction of the wastewater treatment facility project.

  • Resolution 2017-113 a resolution approving payment to Randy and Carol Miller

Motion by Shipley, Seconded by Just, motion carried unanimously

  1. Resolution 2017-114 a resolution authorizing postage purchases

Motioned by Shipley, Seconded by Fors, motion carried unanimously.

  1. Resolution 2017-115 a resolution to adopt and certify the Annual Financial Report for Fiscal Year 2017.

Motioned by Shepley, Seconded by Just, motion carried unanimously.

  1. Resolution 2017-116 a resolution to approve and adopt the Annual Urban Renewal Report for Fiscal Year 2017.

Motioned by Shipley, Seconded by Just, motion carried unanimously.

  1. Ordinances:
    • Second reading of 2017-09 amending the Elkhart Code of Ordinances Chapter 22: Parks and Recreation Board

Motioned by Just to make this the second and final reading of 2017-09, Seconded by Shipley, motion carried unanimously.

  • First reading of 2017-10 amending the Elkhart Code of Ordinances Chapter 165: Zoning Regulations

Motioned by Nolte to make this the first and final reading of 2017-10, Seconded by Shipley, motion carried unanimously.

  1. New and Miscellaneous Business:
    • Discussion regarding junk vehicles in the City of Elkhart

City Clerk notified Council of complaints in regards to junk vehicles and parking violations. Upon discussion of Council it was determined that enforcing the ordinances related to junk vehicles would become a priority item of discussion during upcoming budget workshops after a review of the City Code was conducted.

  • Discussion regarding speed zones in the City of Elkhart

City Clerk notified Council of a complaint about the speed limit on Walnut between Grant and Cedar. Upon discussion by Council it was determined that the area in question being residential should have a lower speed limit of 30 mph rather than the 45 mph that is currently posted. City Clerk was directed to draft an ordinance to amend the speed limit.
